1. General information

This website (agens.pt) is owned and operated by AGENS, with registered office in Portugal.

By accessing and using this website, the user accepts these Terms and Conditions in full. If the user does not agree with any of the terms, they must stop using the website immediately.

AGENS reserves the right to change these terms at any time. Changes take effect once they are published on this page. The update date at the top of this document reflects the latest change.

2. Description of services

AGENS provides consultancy services in operational structuring and the implementation of Artificial Intelligence for service businesses. The services include, among others:

  • Process mapping and creation of SOPs (Standard Operating Procedures)
  • Strategic AI implementation plans
  • Implementation and integration of automations
  • Team training
  • Ongoing support and optimisation

The specific terms of each service are set out in a commercial proposal or individual contract, which prevail over these Terms and Conditions in the event of conflict.

3. Use of the website

The user undertakes to:

  • Use the website only for lawful purposes and in accordance with applicable law
  • Not attempt to access restricted areas of the website or its computer systems
  • Not use the website to transmit content that is unlawful, defamatory, or that infringes the rights of third parties
  • Not use automated tools (bots, scrapers) to collect data from the website without authorisation

4. Free diagnostic

AGENS offers a free 30-minute diagnostic session, which can be booked through the website. This session does not constitute any contractual commitment, binding offer, or obligation to contract services.

AGENS reserves the right to refuse or cancel diagnostic sessions at its discretion, without having to give a reason.

5. Intellectual property

All content on the website, including text, images, graphics, logos, videos, and software, is the property of AGENS or its licensors and is protected by intellectual property rights.

The reproduction, distribution, modification, or commercial use of any content on the website without the prior written authorisation of AGENS is prohibited.

The methodologies, frameworks, and materials developed by AGENS in the course of its services (including SOPs, flowcharts, strategic plans and roadmaps) are the intellectual property of AGENS, unless otherwise agreed in a contract.

6. Limitation of liability

The website is provided “as is” and “as available”. AGENS does not guarantee that the website will always be available or error-free, or that the results obtained will be accurate or complete.

AGENS is not liable for:

  • Direct or indirect damage resulting from the use of, or inability to use, the website
  • Content on third-party websites accessible through links on the website
  • Temporary interruptions of the service for technical or maintenance reasons
  • Data loss resulting from cyberattacks or force majeure events

7. Third-party links

The website may contain links to third-party websites (including YouTube, Google Calendar, and social networks). AGENS does not control and is not responsible for the content, privacy policies, or practices of those websites. The use of third-party websites is the sole responsibility of the user.

8. Data protection

The processing of personal data is governed by our Privacy Policy, which supplements these Terms and Conditions.

9. Applicable law and dispute resolution

These Terms and Conditions are governed by Portuguese law.

To resolve any disputes arising from the use of the website or of AGENS services, the parties may use the alternative dispute resolution mechanisms available on the European Online Dispute Resolution Platform (Plataforma Europeia de Resolução de Litígios em Linha).

If an amicable settlement is not possible, the court of the judicial district (comarca) where AGENS has its registered office shall have jurisdiction.

10. Right of withdrawal (direito de arrependimento)

Under Decree-Law No. 24/2014 (Decreto-Lei n.º 24/2014), the consumer has the right to withdraw from the contract within 14 days of the date on which the service contract is concluded, without having to give any reason.

To exercise this right, the consumer must inform AGENS of their decision by means of an unequivocal statement sent to geral@agens.pt.

The right of withdrawal does not apply where the service has been fully performed with the consumer's prior and express consent.
