AGENS collects personal data in two ways:

2.1. Data provided directly by the user

• Contact and diagnostic forms: name, email, company, sector, number of employees, message
• Session booking: name, email, selected date and time (processed by Google Calendar)
• Job applications: name, email, CV, cover note
• Newsletter / lead magnet: name, email

2.2. Data collected automatically

• IP address
• Browser type and operating system
• Pages visited, length of visit, and interactions
• Traffic source (referrer)
• Cookie data (see section 6)

3. Purposes of processing

Personal data is processed for the following purposes:

• Responding to contact requests and booking diagnostic sessions
• Providing consultancy services that have been contracted
• Sending marketing communications (only with prior and express consent)
• Improving the website and the browsing experience
• Statistical analysis of website usage
• Managing applications for job vacancies
• Complying with legal and tax obligations

4. Legal basis for processing

Personal data is processed on the following legal bases, in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR; in Portuguese, Regulamento Geral sobre a Proteção de Dados, RGPD):

• Consent: for sending marketing communications and for the use of non-essential cookies, including statistical cookies (Google Analytics 4) and interaction analysis cookies (Microsoft Clarity), which are only activated after acceptance in the cookie banner
• Performance of a contract or pre-contractual steps: to respond to contact requests, book diagnostic sessions, and provide contracted services
• Legitimate interest: to ensure the security of the website and prevent fraud
• Compliance with a legal obligation: for tax and accounting obligations

5. Sharing data with third parties

AGENS does not sell, rent, or share personal data with third parties for marketing purposes. Data may be shared with the following service providers, who act as processors:

SCCs = Standard Contractual Clauses of the European Commission, which ensure an adequate level of data protection in international transfers.

Data may also be disclosed to judicial, tax, or regulatory authorities where required by law.

6. Cookies

The agens.pt website uses cookies to ensure it works properly and to improve the user experience.

Types of cookies used

• Essential cookies: necessary for the basic operation of the website. They do not require consent.
• Statistical cookies (opt-in): Google Analytics 4 and Microsoft Clarity, only loaded after express consent in the banner. Without consent, none of these scripts is called.
• Third-party cookies on interaction: YouTube (in youtube-nocookie mode, active only if the user presses play) and Google Calendar (only after the user clicks “Show calendar” on /en/diagnostic).

How to disable cookies

7. Retention periods

• Contact and diagnostic data: up to 1 year after the last contact, unless there is a contractual relationship
• Contractual data: for the duration of the contract and for the period required by law (up to 10 years for tax obligations)
• Analytics data: in accordance with the Google Analytics settings (up to 14 months)
• Marketing data: until consent is withdrawn
• Application data: up to 2 years after the application, unless stated otherwise

8. Data security

AGENS implements appropriate technical and organisational measures to protect personal data against unauthorised access, alteration, disclosure, or destruction, including:

• Encrypted communications via HTTPS/TLS
• Access to data restricted to authorised staff
• Hosting on secure infrastructure (Vercel)
• Periodic review of security measures

In the event of a personal data breach, AGENS will notify the affected data subjects and the competent supervisory authority, the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados, CNPD), within the time limits laid down by law.

9. Rights of the data subject

Under the GDPR, the user has the following rights:

• Right of access: to obtain confirmation and a copy of the data processed
• Right to rectification: to correct inaccurate or incomplete data
• Right to erasure: to request the deletion of the data (“right to be forgotten”)
• Right to restriction of processing: to restrict processing in certain circumstances
• Right to object: to object to processing based on legitimate interest
• Right to data portability: to receive the data in a structured, machine-readable format
• Right to withdraw consent: at any time, without affecting the lawfulness of prior processing
• Right to lodge a complaint: to lodge a complaint with the Portuguese Data Protection Authority (Comissão Nacional de Proteção de Dados, CNPD)

10. Minors

AGENS services are intended exclusively for businesses and professionals. We do not knowingly collect data from anyone under 18. If we become aware that we have collected data from a minor, we will delete it immediately.

11. Changes to this policy

AGENS may update this Privacy Policy at any time. Significant changes will be communicated through the website. The update date at the top of this document reflects the latest change.
